The packets linked below are available in hard copies at the Legal Support Center. If you are not able to come in person to the Center, you can download and print from the links below. Otherwise, if you need help filling out the forms or do not have a way to print them, please come in person to the Legal Support Center.

Visit the Wake County Legal Support Center in person at the Wake County Courthouse, Room 125, located at 316 Fayetteville St., Raleigh, NC 27601, across from the Clerk of Court's office.

Child Custody Complaint (Biological Parents)

Biological parents can use this packet to file a child custody complaint.

Child Custody Complaint (Non-parents)

Non-parents (i.e., grandparents and other family members) can use this packet to file a child custody complaint.

Child Custody Modification

Individuals who are a party to a child custody proceeding can use this packet to file for a child custody modification. Please note that you will need your existing case number and additional information. The best way to file for modification is to visit the Wake County Courthouse and speak with the Family Access Visitation Coordinator, Norma Boyd, who can assist you with this filing.

Custody - Affidavit as to Status of Minor Child

Individuals who need to file for custody or modification for more than one child will need to complete this form for each child.

Custody - Motion for Order to Show Cause and Motion for Contempt

Individuals who are party to an existing custody case can use this packet to file against the other party who is not following terms of the court order. The best way to file for show cause and contempt is to visit the Wake County Courthouse and speak with the Family Access Visitation Coordinator, Norma Boyd, who can assist you with this filing.

Emergency Custody Packet

To file for emergency custody you must come to the Legal Support Center to receive a packet.

Foreign Child Custody Registration

Individuals who want to register Custody orders from a different state with North Carolina. Please note that a certified copy of the original order is required with this filing.

Expedited Foreign Child Custody Registration

Individuals who need to register an order in North Carolina from a different state on an emergency basis. Please note that a certified copy of the original order is required with this filing.

Motion and Order to Continue

Individuals who are party to an existing case can use this packet to motion the court for a continuance of a scheduled hearing.

Absolute Divorce (no other claims)

Individuals who have been separated for at least one year and one day in North Carolina and who do not have any other pending or potential claims (i.e., equitable distribution, alimony, custody, etc.) can use this packet to file for Absolute Divorce.

Small Claims - Summary Ejectment

Landlords (individuals or companies) can use this packet to file an eviction complaint against someone living in their home.

Small Claims - Personal Property

This packet can be used to file a small claims action when the property amount in question is less than $10,000 in value.

Small Claims - Money Owed

This packet can be used to file a small claims action when the amount owed is less than $10,000 in value.

Small Claims - Bond to Stay Execution on Appeal of Summary Ejectment Judgment

Individuals who have had an eviction granted against them can use this packet to file along with an appeal when it is has been less than 10 days since the writ of execution was granted.

Small Claims - Appeal Summary Ejectment

Individuals who have had an eviction granted against them can use this packet to file along with a Bond to Stay Execution on Appeal of Summary Ejectment Judgment when it is has been less than 10 days since the writ of execution was granted.

Small Claims - Appeal Money Owed

Individuals who have had a small claims money owed judgment entered against them can use this packet to appeal the judgment to District Court when it has been less than 10 days since the date the judgment was filed.

Notice of Voluntary Dismissal

Individuals who want to dismiss their case can use this form to do so.
